Privacy Policy
The Privacy Policy outlines how we collect, use, and disclose your personal data when you use the Enforcium Service, including the website, platform, and any associated applications. It also details your privacy rights and provides guidance on how to exercise them.
What Personal Data do we receive?
Personal data refers to any information related to an identified or identifiable individual, including data that Enforcium can link to a specific person. We collect the following categories of your personal data:
- Personal Data. When you create a Enforcium account, we collect your contact information (such as your email address) and login access identifiers (such as your password). Depending on how you then set up your account and payment method and what features you use, we also collect any of the following: first and last name, phone number, mailing address, and other identifiers (date of birth and gender) that you provide to us.
- Payment Information. We collect your payment information and other information to process your payments, including your payment history and billing address.
- Enforcium Account/Profile Information: We collect details related to your Enforcium account, such as profile name, icon, ratings, and comments.
- Usage Information: We gather data on your interactions with the Enforcium service, including profile activity (e.g., activity in work space, progress, saved data), browsing history, search queries, and how you use the service (e.g., text entries, access times, camera/photo use for QR code scanning).
- Settings: Information associated with the preferences and settings on a Enforcium account or user profile, which may include audio and video settings, recording file location, screen sharing settings, and other settings and configuration information.
- Device Information: Information about the computers, phones, and other devices used when interacting with Enforcium, which may include information about the speakers, microphone, camera, OS version, hard disk ID, PC name, MAC address, IP address (which may be used to infer general location at a city or country level), device attributes (like operating system version), WiFi information, and other device information (like Bluetooth signals).
- Content and Context from Collaboration Tools: We collect content and context from features like messaging and other collaborative functions. This may include audio, video, messages, message boards, chat content, transcripts, recommendations, responses to requests and surveys, uploaded files, and other. Enforcium employees do not use this content without the account owner's permission.
Where do we collect personal data?
We receive your personal data from the following sources:
- Directly from You: When you register with Enforcium, update your account or profile, contact us, or participate in surveys, you provide and we collect personal data, payment information, details about your Enforcium account/profile, and messages.
- From Partners: We may collect personal data from third parties ("Partners") whose services you use to access, pay for, or interact with Enforcium. This may include personal information, payment details, usage data, and device/network information. The data provided by Partners depends on their services and your relationship with them.
- Public Sources: We may collect data from public sources, such as public social media posts (e.g., tagging Enforcium, liking or sharing our content) and other information available in public databases, in accordance with current legislation.
How do we use Personal Data?
We use your personal data to provide, maintain, improve and promote the Enforcium service, and to communicate with you. This includes using the above categories of personal data for the following purposes:
- To provide our services, including all features and functionality, websites and applications, user interfaces, and content and software related to the Enforcium service.
- To provide and conduct our business, including processing payments, sending you transactional messages (including confirming your subscription start date or informing you of changes to your account), identifying your internet service provider in order to troubleshoot network problems, responding to your inquiries and requests, and assisting you with technical issues such as changing your password.
- Product Research and Development: If authorized by any applicable settings, to develop, test, and improve Enforcium products and services, and to troubleshoot products and services.
- Marketing and Promotions: If authorized by any applicable settings, to permit Enforcium and/or its third party marketing partners to market, advertise, and promote Enforcium products and services.
- Authentication, Integrity, Security, and Safety: To authenticate accounts and activity, detect, investigate, and prevent malicious conduct, fraudulent activity or unsafe experiences, address security threats, protect public safety, and secure Enforcium.
- Communicate with You: We use personal data to communicate with you about Enforcium products and services, including product updates, your account, and changes to our policies and terms. We also use your information to respond to you when you contact us.
- Legal Reasons: To comply with applicable law or respond to valid legal process, including from law enforcement or government agencies, to investigate or participate in civil discovery, litigation, or other adversarial legal proceedings, protect you, us, and others from fraudulent, malicious, deceptive, abusive, or unlawful activities, and to enforce or investigate potential violations of our Terms of Service or policies.
Whom do we share Personal Data?
- Service Providers. We work with Service Providers who provide services on our behalf or help us provide services to you. Our Service Providers may process your personal data for the purposes set out above.
- Partners. If you have a relationship with one or more of our Partners, we may share certain personal information with them in order to fulfill your requests under applicable law (e.g., invoice payment).
- Enforcium Marketing Providers. When we promote Enforcium through third-party services, some of these services, as well as Marketing Service Providers we engage to purchase, host, optimize or measure the effectiveness of our marketing efforts, may receive information from us.
- Collaboration in the field of advertising. We may cooperate with third parties for advertising campaigns.
- Corporate Transactions. In connection with reorganizations, changes in structure, mergers and sales or other transfers of assets, we will transfer your personal data, provided that the receiving party agrees to treat your personal data in accordance with this Privacy Policy.
- Security, Protection and Fraud Prevention. Enforcium and Service Providers may disclose your personal information to third parties if we reasonably believe it is necessary to do so for security, safety, and fraud prevention purposes.
- To comply with the law and enforce our Terms of Use. We may disclose your personal information if necessary to comply with applicable laws, regulations, legal process or governmental requests, or to protect against infringement of rights, harm to the property or safety of Enforcium, its users or the public as required or permitted by law. We may disclose your personal information to comply with the law and our Terms of Use.
Your rights and controls.
- Access, rectification, updating or deletion of your personal data. You have the right to confirm whether we can process and access your personal data and to obtain a copy of your personal data that we process. You can also correct or update outdated or inaccurate personal data or request the deletion of personal data we hold about you.
- Transferring and downloading a copy of your personal data. You may submit a request to transfer or download a copy of your personal data.
- Prohibition, restriction and withdrawal of consent. You may prohibit the processing of your personal data or request that we restrict it. If we have collected and are processing personal data with your consent, you may withdraw your consent at any time. Withdrawal of consent will not affect the lawfulness of any processing we have carried out prior to such withdrawal; nor will it affect the processing of personal data carried out on the statutory grounds for processing personal data in the absence of consent.
- Right to lodge a complaint. You have the right to complain to an authorized data protection authority about our processing of your personal data, but we recommend that you contact us first if you have any questions or concerns.
- The right to disobey decisions made by automated means. You have the right to disobey a decision made solely by automated means if such a decision would have legal consequences for you or have an equally significant effect.
- Push notifications. You can enable mobile push notifications from Enforcium.
- Emails and Text Messages. If you no longer wish to receive certain communications from us via email or text message, you can opt out.
- You can make cookie settings. The choices regarding our use of cookies and similar technologies are described in the section “Setting Cookies”.
Children
Enforcium does not allow children under the age of 16 to sign up for a Enforcium account. Minors may use the service only with the participation, consent and supervision of a parent or legal guardian
Retention
We retain personal data for as long as required to engage in the uses described in this Privacy Policy, unless a longer retention period is required by applicable law.
The criteria used to determine our retention periods include the following:
- The length of time we have an ongoing relationship with you and provide Enforcium services to you (for example, for as long as you have an account with us or keep using our products);
- Whether account owners modify or their users delete information through their accounts;
- Whether we have a legal obligation to keep the data (for example, certain laws require us to keep records of your transactions for a certain period of time before we can delete them); or
- Whether retention is advisable in light of our legal position (such as in regard to the enforcement of our agreements, the resolution of disputes, and applicable statutes of limitations, litigation, or regulatory investigation).
Security
We take reasonable administrative, logical, physical and managerial measures to protect your personal data from loss, theft, and unauthorized access, use and alteration. These measures are designed to provide a level of security that is appropriate to the risks of processing your personal data.
Sharing sensitive information through our service
You may use the information sharing feature available on our service to share personal information in the following ways:
- certain elements of our service give you the ability to share information in emails, text messages, social media and other data sharing applications using clients and applications on your device;
- information can be shared through social media plug-ins and similar technologies.
Social media plug-ins and applications are controlled by third-party social networks and are governed by their terms of use and privacy policies.
International Data Transfers
Enforcium operates globally, which means personal data may be transferred, stored (for example, in a data center), and processed outside of the country or region where it was initially collected.
Therefore, by using Enforcium products and services or providing personal data for any of the purposes stated above, you acknowledge that your personal data may be transferred to or stored in the EEA, where we are established, as well as in other countries outside of the EEA, the USA, Switzerland, and the UK. Such countries may have data protection rules that are different and less protective than those of your country.
We protect your personal data in accordance with this Privacy Policy wherever it is processed and take appropriate contractual or other steps to protect it under applicable laws. Where personal data of users in the EEA, Switzerland, or the UK is being transferred to a recipient located in a country outside the EEA, Switzerland, or the UK which has not been recognized as having an adequate level of data protection, we ensure that the transfer is governed by the European Commission’s standard contractual clauses. Also, we handle international personal information transfers in accordance with applicable laws, using safeguards like standard contractual clauses to protect your personal information.
EU-US Data Privacy Framework
For personal information transfers from the EU to the US, we adhere to the EU-US Data Privacy Framework, ensuring compliance with various personal information protection principles. Data Security and Breach Notifications We strive to use commercially acceptable means to protect your Personal Information. In the event of personal information breaches, we have an incident response plan to ensure timely notifications, as required by law.
California & Other U.S. State Privacy Rights
But not limited – the “Shine The Light” law (California Civil Code Section 1798.83), California residents may request information about our personal information sharing practices for direct marketing purposes. We do not share personal information with third parties for their marketing purposes without your consent.
COPPA Disclosure
In compliance with the Children’s Online Privacy Protection Act (COPPA), we do not knowingly collect personal information from children under 13. If we become aware of such a collection, we will delete the personal information promptly
Law of Ukraine “On Personal Data Protection”
According to the Law of Ukraine “On Personal Data Protection” we ensure an adequate level of protection for personal information. Data transfers are permitted only when the recipient country guarantees a level of data protection not lower than the requirements of Ukrainian legislation, or when appropriate contracts and standard contractual clauses are applied to ensure data security.
Changes to the Privacy Policy
We will update this Privacy Policy from time to time in response to changes in legal, regulatory and operational requirements. We will provide notice of such changes (and when they become effective) as required by law. Your use of the Enforcium Service after these changes become effective will be deemed to be your knowledge of and agreement to them (if applicable).
